Comparison
Fair dealing applies only to those uses or exceptions mentioned in the law. However, under fair use, the list is illustrative and very subjective. Fair dealing has a narrower scope compared to fair use as fair dealing can be applied only for the given purposes, while fair use should only pass the test of fairness even if used for a purpose not specified. Fair use is flexible and adaptable to changes leading to uncertainty. Fair dealing exceptions have been argued to be uncertain as well, especially terms such as ‘parody’ and ‘satire’ are not defined by law and there exists few case laws on the same.
Why?
1. WikiForge is an American wikifarm. We do not need to go by the British Fair Dealing system.
2. Fair use is more flexible and subjective.
